Chapter 18: When the moon is not seen

פרק יח

The practical side of the sighting. The Rambam explains why a moon the calculation says is visible may still go unseen, and what the court should weigh when questioning witnesses. He then addresses months when the moon goes unseen at the start of the month, one after another, and the tradition of fixing them by calculation, and how in our times we rely on the fixed calendar alone. He ends with how a sighting in lands east or west of the Land of Israel bears on one there.

Twelve months made full in a row, against months alternately full and deficientIn the upper row every month has thirty days, and the night the new crescent is first seen falls about half a day earlier in each month, reaching the twenty-fifth night by the twelfth. In the lower row months alternate between thirty and twenty-nine days and the crescent stays at the start of every month.
A lunar month is 29½ days and a little more (6:3). Make every unseen month full and each runs about half a day long, so the new moon comes earlier in each month than the last — by the end of the year it could be seen on the 25th or 26th (18:6). Fixing one full and one deficient (18:8) keeps the calendar with the moon.

אדָּבָר יָדוּעַ וּבָרוּר, שֶׁאִם יוֹצִיא לְךָ הַחֶשְׁבּוֹן שֶׁהַיָּרֵחַ יֵרָאֶה בַּלַּיְלָה - אֶפְשָׁר שֶׁיֵּרָאֶה וְאֶפְשָׁר שֶׁלֹּא יֵרָאֶה, מִפְּנֵי הֶעָבִים שֶׁמְּכַסִּין אוֹתוֹ, אוֹ מִפְּנֵי הַמָּקוֹם שֶׁהוּא גַּיְא, אוֹ שֶׁהָיָה הַר גָּבוֹהַּ כְּנֶגֶד רוּחַ מַעֲרָב לְאַנְשֵׁי אוֹתוֹ הַמָּקוֹם שֶׁנִּמְצְאוּ כְּאִלּוּ הֵן יוֹשְׁבִין בְּגַיְא.

1It is well known and clear that even if the calculation shows that the moon will be seen on a given night, it may or may not be seen. It may be hidden by clouds, or the place may be a valley, or there may be a high mountain to the west of the people of that place, so that they are as if sitting in a valley.

שֶׁהַיָּרֵחַ לֹא יֵרָאֶה לְמִי שֶׁהוּא בְּמָקוֹם נָמוּךְ, אֲפִלּוּ הָיָה גָּדוֹל, וְיֵרָאֶה לְמִי שֶׁהוּא עוֹמֵד בְּרֹאשׁ הַר גָּבוֹהַּ וְתָלוּל, אַף עַל פִּי שֶׁהַיָּרֵחַ קָטָן בְּיוֹתֵר; וְכֵן יֵרָאֶה לְמִי שֶׁשּׁוֹכֵן עַל שְׂפַת הַיָּם אוֹ לְמִי שֶׁמְּהַלֵּךְ בִּסְפִינָה בַּיָּם הַגָּדוֹל, אַף עַל פִּי שֶׁהוּא קָטָן בְּיוֹתֵר.

For the moon will not be seen by someone in a low place even if it is large, and it will be seen by someone standing on top of a high, steep mountain even if the moon is very small. Likewise it will be seen by someone who lives on the seashore, or who is sailing on the Great Sea, even if it is very small.

בוְכֵן בִּימוֹת הַגְּשָׁמִים, אִם יִהְיֶה צַח, יֵרָאֶה הַיָּרֵחַ יוֹתֵר מִמַּה שֶׁיֵּרָאֶה בִּימוֹת הַחַמָּה. לְפִי שֶׁבִּימוֹת הַגְּשָׁמִים, אִם יִהְיֶה צַח, יִהְיֶה הָאַוִּיר זַךְ הַרְבֵּה וְיֵרָאֶה הָרָקִיעַ בְּטֹהַר יוֹתֵר, מִפְּנֵי שֶׁאֵין שָׁם אָבָק שֶׁיִּתְעָרַב בָּאַוִּיר. אֲבָל בִּימוֹת הַחַמָּה יִהְיֶה הָאַוִּיר כְּאִלּוּ הוּא מְעֻשָּׁן מִפְּנֵי הָאָבָק, וְלֹא יֵרָאֶה הַיָּרֵחַ הַקָּטָן.

2Likewise, in the rainy season, if the sky is clear, the moon is seen more readily than in the summer. For in the rainy season, when it is clear, the air is very pure and the sky is seen more cleanly, since there is no dust mixed into the air. But in the summer the air is as if smoky from the dust, and a small moon is not seen.

גוְכָל זְמָן שֶׁתִּמְצָא קֶשֶׁת הָרְאִיָּה וְהָאֹרֶךְ הָרִאשׁוֹן שֶׁתַּעֲרֹךְ לָהּ עִם שְׁנֵי הַקִּצִּין שֶׁלָּהֶם בְּצִמְצוּם - יִהְיֶה הַיָּרֵחַ קָטָן בְּיוֹתֵר, וְלֹא יֵרָאֶה אֶלָא בְּמָקוֹם גָּבוֹהַּ בְּיוֹתֵר.

3Whenever you find that the arc of sighting and the first longitude you compare with it only just meet their two limits, the moon will be very small and will be seen only from a very high place.

וְאִם תִּמְצָא קֶשֶׁת הָרְאִיָּה וְהָאֹרֶךְ הָרִאשׁוֹן אֲרוּכִין הַרְבֵּה, וְהוֹסִיפוּ עַל סוֹף הַקִּצִּים שֶׁלָהֶן מַעֲלוֹת - יֵרָאֶה הַיָּרֵחַ גָּדוֹל.

If you find the arc of sighting and the first longitude are much longer, going degrees beyond the end of their limits, the moon will be seen large.

וּלְפִי אֹרֶךְ הַקֶּשֶׁת וְהָאֹרֶךְ הָרִאשׁוֹן יִהְיֶה גָּדְלוֹ, וּגְלִיָּתוֹ לַכֹּל.

Its size, and how visible it is to everyone, depends on the length of the arc and of the first longitude.

דלְפִיכָךְ רָאוּי לְבֵית דִּין לָשׂוּם שְׁנֵי דְּבָרִים אֵלּוּ בְּלִבָּם, שֶׁהֵן: זְמָן הָרְאִיָּה וּמְקוֹמָהּ, וְשׁוֹאֲלִין אֶת הָעֵדִים 'בְּאֵיזֶה מָקוֹם רְאִיתֶם?'

4So the court should keep two things in mind: the time of the sighting and its place. They ask the witnesses, "Where did you see it?"

שֶׁאִם הָיְתָה קֶשֶׁת הָרְאִיָּה קְצָרָה, וְיִתֵּן הַחֶשְׁבּוֹן שֶׁיֵּרָאֶה בְּצִמְצוּם, כְּגוֹן שֶׁהָיְתָה קֶשֶׁת הָרְאִיָּה תֵּשַׁע מַעֲלוֹת וַחֲמִשָּׁה חֲלָקִים, וְהָיָה הָאֹרֶךְ הָרִאשׁוֹן שְׁלוֹשׁ עֶשְׂרֵה מַעֲלוֹת בְּשָׁוֶה, וּבָאוּ עֵדִים שֶׁרָאוּהוּ: אִם הָיָה בִּימוֹת הַחַמָּה, אוֹ שֶׁהָיָה בְּמָקוֹם נָמוּךְ - חוֹשְׁשִׁין לָהֶן, וּבוֹדְקִין אוֹתָן הַרְבֵּה; וְאִם הָיָה בִּימוֹת הַגְּשָׁמִים, אוֹ בְּמָקוֹם גָּבוֹהַּ בְּיוֹתֵר - וַדַּאי יֵרָאֶה, אִם לֹא יִהְיוּ שָׁם עָבִים הַמַּבְדִּילִין.

If the arc of sighting is short and the calculation shows that the moon can only just be seen, for example the arc of sighting is 9°5' and the first longitude is exactly 13°, and witnesses come who saw it: if it was in the summer, or in a low place, the court is suspicious of them and examines them closely. If it was in the rainy season, or in a very high place, it will certainly be seen, unless clouds are in the way.

העֵדִים שֶׁרָאוּ אֶת הַחֹדֶשׁ בִּזְמַנּוֹ וּבָאוּ וְהֵעִידוּ, וְקִבְּלוּם בֵּית דִּין וְקִדְּשׁוּ אֶת הַחֹדֶשׁ הַזֶּה הָרִאשׁוֹן, וּמָנוּ תִּשְׁעָה וְעֶשְׂרִים יוֹם מִן הַיּוֹם הַמְּקֻדָּשׁ, וְלֵיל שְׁלוֹשִׁים לֹא נִרְאָה הַיָּרֵחַ, מִפְּנֵי שֶׁאִי אֶפְשָׁר לוֹ לְהֵרָאוֹת אוֹ מִפְּנֵי שֶׁכִּסּוּהוּ עָבִים, וַהֲרֵי בֵּית דִּין מְצַפִּין לוֹ כָּל יוֹם שְׁלוֹשִׁים כְּמוֹ שֶׁבֵּאַרְנוּ, וְלֹא בָאוּ עֵדִים, וְעִבְּרוּ אֶת הַחֹדֶשׁ, וְנִמְצָא יוֹם רֹאשׁ הַחֹדֶשׁ הַשֵּׁנִי יוֹם אֶחָד וּשְׁלוֹשִׁים כְּמוֹ שֶׁבֵּאַרְנוּ.

5Witnesses saw the new moon at its proper time and came and testified; the court accepted them and sanctified this first month. They counted twenty-nine days from the sanctified day, and on the night of the thirtieth the moon was not seen, either because it could not be seen or because clouds covered it. The court waited for it all through the thirtieth day, as we explained, but no witnesses came, so they made the month full, and Rosh Chodesh of the second month fell on the thirty-first day, as we explained.

ווְהִתְחִילוּ לִמְנוֹת תִּשְׁעָה וְעֶשְׂרִים יוֹם מִן יוֹם רֹאשׁ הַחֹדֶשׁ הַשֵּׁנִי, וְלֵיל שְׁלוֹשִׁים לֹא נִרְאָה הַיָּרֵחַ - אִם תֹּאמַר שֶׁכָּךְ מְעַבְּרִין רֹאשׁ חֹדֶשׁ זֶה וְעוֹשִׂין אוֹתוֹ שְׁלוֹשִׁים, וְקוֹבְעִין רֹאשׁ הַחֹדֶשׁ הַשְּׁלִישִׁי יוֹם אֶחָד וּשְׁלוֹשִׁים - כָּךְ אֶפְשָׁר שֶׁלֹּא יֵרָאֶה הַיָּרֵחַ בְּלֵיל שְׁלוֹשִׁים, גַּם מֵחֹדֶשׁ זֶה, וְנִמְצְאוּ מְעַבְּרִין וְהוֹלְכִין וְעוֹשִׂין חֳדָשִׁים שְׁלוֹשִׁים אַחַר שְׁלוֹשִׁים, כָּל הַשָּׁנָה כֻּלָּהּ, וְנִמְצָא בְּחֹדֶשׁ אַחֲרוֹן, אֶפְשָׁר שֶׁיֵּרָאֶה הַיָּרֵחַ בְּלֵיל חֲמִשָּׁה וְעֶשְׂרִים בּוֹ אוֹ בְּלֵיל שִׁשָּׁה וְעֶשְׂרִים - וְאֵין לְךָ דְּבַר שְׂחוֹק וְהֶפְסֵד יוֹתֵר מִזֶּה.

6They began counting twenty-nine days from Rosh Chodesh of the second month, and on the night of the thirtieth the moon was not seen. If you say that this month too is made full, thirty days, and Rosh Chodesh of the third month is fixed on the thirty-first day, then the moon might fail to be seen on the night of the thirtieth of this month as well. They would go on making every month full, thirty after thirty, the whole year through, until in the last month the moon might be seen on the night of its twenty-fifth or twenty-sixth day. There is nothing more absurd or damaging than that.

זוְאַל תֹּאמַר שֶׁהַדָּבָר הַזֶּה דָּבָר שֶׁאֵינוֹ מָצוּי הוּא, שֶׁלֹּא יֵרָאֶה הַיָּרֵחַ בְּכָל הַשָּׁנָה.

7Do not say that this is something that does not happen, that the moon is not seen for a whole year.

אֶלָא דָּבָר קָרוֹב הוּא, הַרְבֵּה, וּפְעָמִים רַבּוֹת יֶאֱרַע זֶה וְכַיּוֹצֵא בּוֹ, בַּמְּדִינוֹת שֶׁזְּמַן הַגְּשָׁמִים שָׁם אָרוּךְ וְהֶעָבִים רַבִּים; שֶׁאֵין אָנוּ אוֹמְרִין שֶׁלֹּא יֵרָאֶה הַיָּרֵחַ בְּכָל הַשָּׁנָה, אֶלָא שֶׁלֹּא יֵרָאֶה בִּתְחִלַּת הֶחֳדָשִׁים וְיֵרָאֶה אַחַר כָּךְ בַּיָּמִים.

On the contrary, it is quite likely, and this and similar things happen many times in countries where the rainy season is long and the clouds are many. We are not saying that the moon is not seen for the whole year, only that it is not seen at the beginnings of the months, and is seen later in the month.

וּפְּעָמִים, לֹא יֵרָאֶה מִפְּנֵי שֶׁאִי אֶפְשָׁר לוֹ שֶׁיֵּרָאֶה, וָחֳדָשִׁים שֶׁאֶפְשָׁר שֶׁיֵּרָאֶה בָּהֶם, לֹא יֵרָאֶה בָּהֶם מִפְּנֵי הֶעָבִים, אוֹ מִפְּנֵי שֶׁהָיָה קָטָן בְּיוֹתֵר, וְלֹא נִתְכַּוֵּן אָדָם לִרְאוֹתוֹ.

Sometimes it is not seen because it cannot be seen. And in months when it could be seen, it is not seen because of clouds, or because it was very small and no one set out to look for it.

חאֶלָא הַקַּבָּלָה שֶׁבְּיַד הַחֲכָמִים, אִישׁ מִפִּי אִישׁ מִפִּי מֹשֶׁה רַבֵּנוּ, כָּךְ הִיא: שֶׁבִּזְמַן שֶׁלֹּא יֵרָאֶה הַיָּרֵחַ בִּתְחִלַּת הֶחֳדָשִׁים חֹדֶשׁ אַחַר חֹדֶשׁ, בֵּית דִּין קוֹבְעִין חֹדֶשׁ מְעֻבָּר מִשְּׁלוֹשִׁים יוֹם, וְחֹדֶשׁ חָסֵר מִתִּשְׁעָה וְעֶשְׂרִים יוֹם. וְכֵן מְחַשְּׁבִין, וְקוֹבְעִין חֹדֶשׁ מְעֻבָּר וְחֹדֶשׁ חָסֵר - בִּקְבִיעָה לֹא בְּקִדּוּשׁ, שֶׁאֵין מְקַדְּשִׁין אֶלָא עַל הָרְאִיָּה.

8Rather, the tradition that the Sages hold, one person from another back to Moses our teacher, is this: when the moon is not seen at the beginnings of the months, month after month, the court fixes one month full, of thirty days, and one month deficient, of twenty-nine days. This is how they calculate and fix full and deficient months: by fixing, not by sanctifying, for they sanctify only on the basis of sighting.

וּפְעָמִים עוֹשִׂין מָלֵא אַחַר מָלֵא, אוֹ חָסֵר אַחַר חָסֵר, כְּמוֹ שֶׁיֵּרָאֶה לָהֶם מִן הַחֶשְׁבּוֹן.

Sometimes they make one full month after another, or one deficient month after another, as they see fit from the calculation.

טוּמִתְכַּוְּנִין לְעוֹלָם בְּחֶשְׁבּוֹנָם, שֶׁאִם יֵרָאֶה הַיָּרֵחַ בַּחֹדֶשׁ הַבָּא, יֵרָאֶה בִּזְמַנּוֹ אוֹ בְּלֵיל עִבּוּרוֹ, לֹא שֶׁיֵּרָאֶה קֹדֶם זְמַנּוֹ, שֶׁהוּא לֵיל שְׁמוֹנֶה וְעֶשְׂרִים.

9In their calculation they always aim that, if the moon is seen in the following month, it will be seen at its proper time or on the night of its fullness [the thirty-first night], not before its time, which is the night of the twenty-eighth.

וּבְחֶשְׁבּוֹנוֹת הָרְאִיָּה הָאֵלּוּ שֶׁבֵּאַרְנוּ, יִתְבָּאֵר לְךָ וְתֵדַע מָתַי אֶפְשָׁר שֶׁיֵּרָאֶה וּמָתַי אִי אֶפְשָׁר שֶׁיֵּרָאֶה; וְעַל זֶה סוֹמְכִין וּמְעַבְּרִין חֹדֶשׁ אַחַר חֹדֶשׁ, אוֹ עוֹשִׂין חֹדֶשׁ חָסֵר אַחַר חֹדֶשׁ חָסֵר.

Through these calculations of the sighting that we explained, it will become clear to you when the moon can be seen and when it cannot. On this they rely when they make one month full after another, or one deficient month after another.

וּלְעוֹלָם אֵין פּוֹחֲתִין מֵאַרְבָּעָה חֳדָשִׁים הַמְּעֻבָּרִין בְּשָׁנָה, וְלֹא מוֹסִיפִין עַל שְׁמוֹנָה חֳדָשִׁים הַמְּעֻבָּרִין.

There are never fewer than four full months in a year, and never more than eight full months.

וְגַם לְעִבּוּר חֳדָשִׁים אֵלּוּ שֶׁמְּעַבְּרִין לְפִי חֶשְׁבּוֹן, עוֹשִׂין סְעוּדַת עִבּוּר הַחֹדֶשׁ שֶׁאָמַרְנוּ בְּפֵרֶק שְׁלִישִׁי.

For the full months that are made full by calculation, too, they hold the meal for making the month full that we mentioned in Chapter 3.

יוְכָל שֶׁתִּמְצָא בַּתַּלְמוּד מִדְּבָרִים שֶׁמַּרְאִין שֶׁבֵּית דִּין סוֹמְכִין עַל הַחֶשְׁבּוֹן, וּמִפִּי מֹשֶׁה מִסִּינַי שֶׁהַדָּבָר מָסוּר לָהֶם וְהָרְשׁוּת בְּיָדָם לְחַסֵּר אוֹ לְעַבֵּר, וְכֵן זֶה שֶׁחִסֵּר רַבִּי תִּשְׁעָה חֳדָשִׁים בְּשָׁנָה, וְכָל כַּיּוֹצֵא בְּזֶה - הַכֹּל עַל עִיקָר זֶה הוּא בָּנוּי, בִּזְמַן שֶׁלֹּא נִרְאָה הַחֹדֶשׁ בִּזְמַנּוֹ.

10Whatever you find in the Talmud showing that the court relied on calculation, and that it was handed down from Moses at Sinai that the matter was entrusted to them and they had the authority to make a month deficient or full, and likewise Rebbi making nine months deficient in one year, and everything similar: all of it is built on this principle, for times when the moon was not seen at its proper time.

יאוְכֵן זֶה שֶׁאָמְרוּ חֲכָמִים שֶׁמְּעַבְּרִין אֶת הַחֹדֶשׁ לְצֹרֶךְ, הוּא בָּחֳדָשִׁים אֵלּוּ שֶׁמְּעַבְּרִין אוֹתָן לְפִי חֶשְׁבּוֹן, וְעוֹשִׂין אֶחָד מָלֵא וְאֶחָד חָסֵר, וְיֵשׁ לָהֶם לְעַבֵּר חֹדֶשׁ אַחַר חֹדֶשׁ אוֹ לְחַסֵּר - בָּזֶה הוּא שֶׁמְּעַבְּרִין לְצֹרֶךְ, מִפְּנֵי שֶׁלֹּא נִרְאָה הַיָּרֵחַ בִּזְמַנּוֹ; אֲבָל בְּעֵת שֶׁיֵּרָאֶה הַיָּרֵחַ בִּזְמַנּוֹ, שֶׁהוּא תְּחִלַּת הֱיוֹתוֹ נִרְאֶה אַחַר שֶׁנִּתְקַבֵּץ עִם הַשֶּׁמֶשׁ - מְקַדְּשִׁין לְעוֹלָם.

11Likewise, what the Sages said, that a month may be made full when needed, refers to these months that are made full by calculation, where they make one full and one deficient, and have the choice to make one month after another full or deficient. In this they make a month full when needed, because the moon was not seen at its proper time. But when the moon is seen at its proper time, which is when it first becomes visible after its conjunction with the sun, they always sanctify the month.

יבוְכָל הַדְּבָרִים הָאֵלּוּ, בִּזְמַן שֶׁיֵּשׁ שָׁם בֵּית דִּין, וְסוֹמְכִין עַל הָרְאִיָּה; אֲבָל בִּזְמַנִּים אֵלּוּ, אֵין סוֹמְכִין אֶלָא עַל הַקְּבִיעָה בְּזֶה הַחֶשְׁבּוֹן הָאֶמְצָעִי, הַפָּשׁוּט בְּפִי כָּל יִשְׂרָאֵל, כְּמוֹ שֶׁבֵּאַרְנוּ בַּהֲלָכוֹת אֵלּוּ.

12All these things apply when there is a court and it relies on sighting. But in these times, we rely only on the fixing by this mean calculation, which is familiar to all of Israel, as we explained in these laws.

יגיִתְבָּאֵר בְּסִפְרֵי חֶשְׁבּוֹן הַתְּקוּפוֹת וְהַגֵּימְטַרְיוֹת, שֶׁאִם יֵרָאֶה הַיָּרֵחַ בְּאֶרֶץ יִשְׂרָאֵל, יֵרָאֶה בְּכָל מְדִינוֹת הָעוֹלָם שֶׁהֵן לְמַעֲרַב אֶרֶץ יִשְׂרָאֵל וּמְכֻוָּנוֹת כְּנֶגְדָּהּ. וְאִם יִתֵּן הַחֶשְׁבּוֹן שֶׁלֹּא יֵרָאֶה בְּאֶרֶץ יִשְׂרָאֵל, אֶפְשָׁר שֶׁיֵּרָאֶה בִּמְדִינוֹת אֲחֵרוֹת שֶׁהֵן לְמַעֲרַב אֶרֶץ יִשְׂרָאֵל וּמְכֻוָּנוֹת כְּנֶגְדָּהּ.

13It is shown in the books of astronomy and geometry that if the moon is seen in the Land of Israel, it will be seen in every country of the world that lies west of the Land of Israel and is aligned with it. And if the calculation shows that it will not be seen in the Land of Israel, it may still be seen in other countries that lie west of the Land of Israel and are aligned with it.

לְפִיכָךְ: אִם יֵרָאֶה הַיָּרֵחַ בִּמְדִינָה שֶׁהִיא לְמַעֲרַב אֶרֶץ יִשְׂרָאֵל, אֵין בְּזֶה רְאָיָה שֶׁנִּרְאָה הַיָּרֵחַ בְּאֶרֶץ יִשְׂרָאֵל.

So if the moon is seen in a country west of the Land of Israel, that is no proof that the moon was seen in the Land of Israel.

ידאֲבָל אִם לֹא יֵרָאֶה הַיָּרֵחַ בְּרָאשֵׁי הֶהָרִים בַּמְּדִינָה הַמַּעֲרָבִית הַמְּכֻוֶּנֶת כְּנֶגֶד אֶרֶץ יִשְׂרָאֵל, בַּיָּדוּעַ שֶׁלֹּא נִרְאָה בְּאֶרֶץ יִשְׂרָאֵל.

14But if the moon is not seen from the mountaintops of a western country aligned with the Land of Israel, it is known that it was not seen in the Land of Israel.

טווְכֵן אִם לֹא יֵרָאֶה הַיָּרֵחַ בְּאֶרֶץ יִשְׂרָאֵל, בַּיָּדוּעַ שֶׁלֹּא יֵרָאֶה בְּכָל מְדִינוֹת הָעוֹלָם שֶׁהֵן לְמִזְרַח אֶרֶץ יִשְׂרָאֵל וּמְכֻוָּנוֹת כְּנֶגְדָּהּ; וְאִם יֵרָאֶה בְּאֶרֶץ יִשְׂרָאֵל, אֶפְשָׁר שֶׁיֵּרָאֶה בִּמְדִינוֹת מִזְרָחִיּוֹת וְאֶפְשָׁר שֶׁלֹּא יֵרָאֶה.

15Likewise, if the moon is not seen in the Land of Israel, it is known that it will not be seen in any country of the world east of the Land of Israel and aligned with it. If it is seen in the Land of Israel, it may or may not be seen in the eastern countries.

לְפִיכָךְ: אִם יֵרָאֶה בִּמְדִינָה שֶׁהִיא לְמִזְרַח אֶרֶץ יִשְׂרָאֵל וּמְכֻוֶּנֶת כְּנֶגְדָּהּ, בַּיָּדוּעַ שֶׁנִּרְאָה בְּאֶרֶץ יִשְׂרָאֵל; וְאִם לֹא יֵרָאֶה בַּמְּדִינָה הַמִּזְרָחִית, אֵין בְּזֶה רְאָיָה, אֶלָא אֶפְשָׁר שֶׁיֵּרָאֶה בְּאֶרֶץ יִשְׂרָאֵל.

So if it is seen in a country east of the Land of Israel and aligned with it, it is known that it was seen in the Land of Israel. If it is not seen in the eastern country, that is no proof; it may still have been seen in the Land of Israel.

טזוְכָל אֵלּוּ הַדְּבָרִים בְּשֶׁהָיוּ הַמְּדִינוֹת שֶׁבְּמַעֲרָב וְשֶׁבְּמִזְרָח מְכֻוָּנוֹת, כְּגוֹן שֶׁהָיוּ נוֹטוֹת לִצְפוֹן הָעוֹלָם מִשְּׁלוֹשִׁים מַעֲלוֹת עַד חָמֵשׁ וּשְׁלוֹשִׁים מַעֲלוֹת.

16All this applies when the western and eastern countries are aligned with it, for example when they lie north of the equator by 30° to 35°.

אֲבָל אִם הָיוּ נוֹטוֹת לַצָּפוֹן יוֹתֵר מִזֶּה אוֹ פָּחוֹת, מִשְׁפָּטִים אֲחֵרִים יֵשׁ לָהֶן - שֶׁהֲרֵי אֵינָן מְכֻוָּנוֹת כְּנֶגֶד אֶרֶץ יִשְׂרָאֵל.

If they lie further north than this, or less, other rules apply to them, since they are not aligned with the Land of Israel.

וּדְבָרִים אֵלּוּ שֶׁבֵּאַרְנוּ בְּעָרֵי מִזְרָח וּמַעֲרָב, אֵינָן אֶלָא לְהַגִּיד כָּל מִשְׁפְּטֵי הָרְאִיָּה לְהַגְדִּיל תּוֹרָה וּלְהַאְדִּירָהּ - לֹא שֶׁיִּהְיוּ בְּנֵי מִזְרָח אוֹ בְּנֵי מַעֲרָב סוֹמְכִין עַל רְאִיַּת הַיָּרֵחַ אוֹ תּוֹעִיל לָהֶם כְּלוּם, אֶלָא לְעוֹלָם אֵין סוֹמְכִין אֶלָא עַל קִדּוּשׁ בֵּית דִּין שֶׁבְּאֶרֶץ יִשְׂרָאֵל, כְּמוֹ שֶׁבֵּאַרְנוּ כַּמָּה פְּעָמִים.

What we have explained about eastern and western cities is only to set out all the laws of sighting, to make the Torah great and glorious. It is not so that the people of the east or west should rely on sighting the moon, or that it should help them at all. We always rely only on the sanctification by the court in the Land of Israel, as we have explained many times.

The Rambam builds the calculation on Jerusalem and the places around it within about six or seven days' journey (11:17): about 32° north of the equator (29° to 35°), and about 24° west of the middle of the inhabited world (21° to 27°) — three degrees either way, which is the box drawn round the city. The lands east and west of it between 30° and 35° north are the ones "aligned" with it (18:16) — a moon seen here is seen in them to the west, and a moon not seen here is not seen in them to the east (18:13–15). The countries are today's.
